Everything you do in government is govt property, that means your notes, your memos and your doodles. And it's illegal to take them from the government and use them for your own purposes. It's generally a minor crime, unless the information deals with something related to National Security.

Everything dealing with the POTUS is considered national security, until it is vetted as not National Security.

If they want to pursue Comey for using public records illegally, they can, but I think that would be a mistake optics-wise. Putting some penny-ante bullshit ahead of transparency in the public interest looks like some pretty cynical misdirection.

And if Comey's memos prove to have national security implications, I would hope they would run him up for that... but I am pretty sure he could be said to have reliably vetted them as he made them, being head of the FBI at the time and all.

I don't know who they might be, but....

Yeah, that was kind of sloppy, but they would be the camp that is trying to defend POTUS from the appearance of wrongdoing. His team could try to force the justice department to go after Comey for inappropriate use of gub'ment property... but I don't think it will really stick, and will make them look like they're standing against the public interest in a petty way.

Yeah, it is going to fun watching how the sausage is made. And leaking is a huge part of how DC operates.

The big problem for Comey is not directly related to the leak of this memo dealing with the POTUS* The big problem is your former FBI head is an admitted leaker of information. That means you need to find out what else he has done, how many times has he leaked information. There should be agents right now ceasing computers and documents from his buddy the Columbia Prof., they should be tearing through his records to see what else Comey has done just because he wanted to and didn't want to go through proper channels.

* Comey leaked this to the NYTimes, and we find out in his testimony that Comey knows they are printing false stuff about the POTUS and they are hostile toward the POTUS. That's pretty shady shit.
