Not at all. The law has a maximum sentence of 6 months but is usually enforced with a fine or simply an order to remove the offending material.StCapps wrote: ↑Sat Feb 22, 2020 9:51 amYou are the one who wants to lock them up and throw away the key if they say anything you find to be "hate filled" and a court of law agrees with you. The problem with these chuckle heads is they are, deep down, total moral relativists. There are no important moral distinctions between any states, the UK is more or less exactly the same as authoritarian China. America is slightly better only in so far as it doesn't function like a well ordered state.
They also resent the lawful order that protects them and allows them to thrive, and labor under absurd fantasies about how successful they would be as Ubermensch, free from onerous restrictions... like not being able to say nigger on youtube without being demonetized.
Oh lord, let these shackles fall from us, so we can escape from speech prison.
I am perfectly happy with that and would never want a life sentence imposed. I never suggested, for example, that Count Duckula should be imprisoned and I repeatedly said that a fine was the most likely outcome despite what all the MHF doomsayers were claiming.
Only the most extreme cases have resulted in a custodial sentence and most of them have been suspended.
For legal reasons, we are not threatening to destroy U.S. government property with our glorious medieval siege engine. But if we wanted to, we could. But we won’t. But we could.

Well even fines shouldn't be a thing, let alone any amount of jail time. They shouldn't even have to go court for that shit, especially in Dankula's case.Montegriffo wrote: ↑Sat Feb 22, 2020 10:07 amNot at all. Hate speech laws suck, all downside with zero upside despite going to the drastic step of restricting freedom for the zero upside.

You can, unless it can be proved to be an incitement to hatred likely to lead to harassment, discrimination or intimidation. This is not about banning individual words, it is about reducing the tools of division likely to end in criminal offenses such as shooting up shisha bars.

Re: Europe, Boring Until it's Not
You aren't reducing the tools for division though, you are enhancing them by banning hate speech. You made hate speech extra taboo with the legal penalties, which increases it's popularity. You can't win the war on drugs, what makes you think you can win the war on speech with the same strategy and tactics that failed in the war against something that wasn't a fundamental human freedom and is actual tangible property you can smell and touch, instead of an idea?Montegriffo wrote: ↑Sat Feb 22, 2020 10:14 amYou can, unless it can be proved to be an incitement to hatred likely to lead to harassment, discrimination or intimidation. You can't kill an idea, especially via government regulation. Far better to attack the idea in open discourse, instead of driving all the most hateful ideas underground so they can't be publicly discredited in a way which reduces the spread of that idea, pro tip.

You should be able to get paid for it, but youtube is too stupid to allow that, and that is of course their prerogative. That just leaves a hole in the market for youtube's competition to exploit.Hanarchy Montanarchy wrote: ↑Sat Feb 22, 2020 10:25 amYou can. You just might not be able to get paid for it.

Strictly speaking, Duckula was not charged under UK laws against speech leading to incitement to hatred. He was convicted under Scottish law on grossly offensive material under the Communications Act. Another clearly defined restriction on freedom of speech.StCapps wrote: ↑Sat Feb 22, 2020 10:13 amWell even fines shouldn't be a thing, let alone any amount of jail time. His right to appeal was recently turned down.
The freedom to cause distress is not a right under Scottish law.A letter from the court said the appeal was “without merit … not arguable and in each of its elements is wholly misconceived”.
“This was a deeply unpleasant offence in which disgraceful and utterly offensive material was very widely distributed by the appellant,” it said.
“This was to the considerable distress of the community in question and – just as disturbingly – to the apparent approval of a large number of persons who appear to share the appellant’s racist views.”

This assumes that 1) people are amenable to reason, which they usually aren't. Especially when their hackles are up, and 2) that all bad ideas are wrong, which they might not be. There may be true things that it is better that people don't know.
We should have never translated the bible into the Vulgate. That is when every idiot got big ideas about their ability to understand things.
