Prenups do NOT have to be "government approved." No license is required to enter into one. You don't have to ask permission of the magistrate to sign one.
However, if you try to write up your own, you are extremely likely to fuck it all up and cry watching a judge wipe her ass with it.

Try drawing up an actual contract on your own computer (as a private citizen without a license of some kind), having someone else sign it, and putting it through the court system.
