The rules vary, as they of course should, from state to state. There are appeals from arbitrary rulings by trial judges to state courts of appeal and state supreme courts. No results are guaranteed there, either; but results are at least somewhat more predictable in those courts.
The moral of the story is to know the rules applicable in your state before you take action. Good lawyers actually serve this function for you when needed. If the rules are sketchy, move to another state or don't take the action. Or go see your rep or run for office, I guess.
Marriage pursuant to a state license is a risky business; so is sticking your dick in an unsure place. Nobody's gonna eliminate those risks completely, but if you help yourself, you can mitigate them.
