Need Advice - firing someone
So as much as you guys are a bunch of degenerate assholes. I do appreciate the collective wisdom of people on this board.
I feel I need to fire someone and I wanted your opinions.
Guy brings in about 2.5 million (1 million of it profit) in revenue and makes about 200k. He’s highly profitable and valuable to us.
He is in a critical role where if he left and went to a competitor, he could hurt us. He knows our secret sauce. He has an NDA but generally those are pretty hard to enforce.
I’ve found out that he’s been abusing his company credit card. 5k in illegitimate charges this month.
The money is of course peanuts compared to what he brings in, but I have always believed that if someone will steal a small amount, they will steal a large amount if there is real money on the table. I also believe he feels he’s untouchable because he is valuable to us. I believe those two things are a dangerous combination and indicative of a problematic personality trait. I believe that it’s only a matter of time before people like that will fuck you over, they can’t help themselves.
Anyways, curious to hear your thoughts.

Something like that needs to go through the law firm that represents your employer. The NDA is very easy to enforce if he has grand larceny hanging over his head.
There might be something fucked up going on his life, though. Are you able to see what he is spending the credit on?

Discuplinary action, probation period, keep an eye on him afterwards anyway. Let him fire himself if he doesn’t like it, your hands clean.

He's probably going to fuck you over as soon as you fire him which is probably why he's abusing your charity already. I would just insist he takes me out to the titty bars as well. Life is short. It's also possible he's taking the guys, (the laborers that dont make shit if there are any there,) for steaks at Hooters and shit. If that's the case he's less untrustworthy than he seems because he feels like he's looking out for the little guys at the job. I knew a guy in sales like that. They fired him and then he fucked them over big time. Big mistake imo.

Just work up an intel file on him for now, gather evidence, keep it in your hip pocket, establish an unassailable pattern, then before you fire him, confront him with it and see what he has to say.

We do retain a pretty high level law firm. I don’t think it is larceny, probably more of wrongful appropriation because it is pretty easy to collect, the evidence is clear.
We had an $800 charge at Macy’s, some resort for $500 etc... He wasn’t paying medical bills with this, it’s pretty clear it was lifestyle spending.
What makes me so upset is that he is claiming he confused his personal credit card with the company one. He made this mistake before (3 months ago) and I let it go, it made sense if it happened once (both are black and look similar). But this happened multiple occasions, and it’s all high dollar. If this is a mistake, why am I not seeing grocery or Best Buy bills? Only $400 plus.
It doesn’t add up.

We are very permissive with customer spending (spend money to make money) but he is spending it on resorts and Macy’s and shit. Clearly not taking care of the blue collar boys (which I could forgive).

Another option would be just claw it back out of his compensation, if he comes to you and says he was shorted, you say, oh, no, we settled it up, the stuff from the credit you billed to us, we just deducted that.

I’m debating wheather to call him on his bullshit or just be robotic and say he violated policy.
