In Shift, Justice Dept. Says Law Doesn’t Bar Transgender Discrimination
WASHINGTON — Attorney General Jeff Sessions on Thursday ordered the Justice Department to take the position in court cases that transgender people are not protected by a civil rights law that bans workplace discrimination based on sex. The move was the Trump administration’s latest contraction of the Obama-era approach to civil rights enforcement.

The dispute centers on how to interpret employment protections based on “sex” in Title VII of the Civil Rights Act of 1964. In December 2014, the attorney general at the time, Eric H. Holder Jr., ordered the Justice Department to view “sex” as encompassing gender identity, extending protections to transgender people.

But in a two-page memo to all United States attorneys and other top officials, Mr. Sessions revoked Mr. Holder’s directive. The word “sex” in the statute, Mr. Sessions said, means only “biologically male or female,” so the Civil Rights Act does not ban “discrimination based on gender identity per se, including transgender status.”

He added that the department “will take that position in all pending and future matters,” except in cases in which a controlling lower-court precedent dictated otherwise, in which case it would reserve the option to revisit the issue on appeal.

Anorexics self-identify as 'fat', but they aren't.
In fact, indulging them in their obviously erroneous self-perception is harmful to them.
Seems like a reasonable call.

I'm not saying it's ok not to hire transgender people, or we should shun them from the workplace and force them into a life of poverty and desperation because they can't find employment. I'm saying I think it's reasonable not to force employers to buy into their self-identity or to force employers to accommodate their self-identity.

I look at that whole thing as a mental illness. And our weird reactions to it as part of our weird obsession with sex. If I wanted to chop off my arm because I didn't think I should have it I would be committed, but my dick? That's a life choice.

Anyways, I think they should be protected under civil rights law. If you are discriminated against because your're weird (in that way) than that is wrong. I've seen plenty of cruelty towards those folks for no fucking reason, it's disgusting and should be punished.

In this case, preventing discrimination forces the employer to provide additional accommodations. We can integrate blacks and gays into the workforce without having to create gender neutral bathrooms, or adding 'xir' to all the onboarding paperwork. As transgenders "otherness" exists completely between their own ears and nowhere in physical reality, it seems a little onerous to force employers to accommodate their employee's imaginations, don't you think?

Agree with that. Society doesn't need to totally change itself for less than 1% of the population.

However all that isn't necessarily included in such legislation. We could.... idk apply a little nuance when we write a law specifically for them?

Well, this seems to amount to a stupifyingly obtuse reading of the law, and violates the spirit of it, but should make some portion of the base happy for a minute, that they can fire the 'queers' from their non-existent businesses.

What a fantastic waste of momentum. This administration is the equivalent of an e-brake on its own progress.

It's a great solution to the obvious scenario of a male employee saying he is a woman in order to gain preferential treatment.

These people need help, not encouragement and changes to our laws.
