"Grossly," is about as vague and subject to interpretation as you can get. I can't think of a worse criteria for making law.

George Bush once stated he didn't like broccoli and the whole broccoli farmers association took offense. There is literally nothing that can come out of your mouth that won't offend someone.

Now you are going to leave it up to ONE judge to decide if it meets the "grossly," criteria? Any number of biases could contribute to where one judge sees "grossly" and another judge sees "funny."
