You are missing the point of a salary. Professionals do not work like you do. There is no clock.

If your job has no set hours then how does this affect you?
If however your hours of work are 9-5
but you are expected to spend 2 hours a night working after you get home and this wasn't in your contract of employment then this law would protect you.

Work hours and having to answer your email are two different things. Even in England professionals work like this just fine.

Guess American firms based in NY will have to fire all their Euro employees, since trying to carry on any real-time communication with them might require a NYC employee to answer email after 5pm.

When I have to work 2:00 a.m. - 4:00 a.m. for a system update, it's completely outside of my regular work hours. On the plus side, I don't have to check my email from 8:00 - 9:00 a.m. (during regular work hours) later that day, 'cause I'm probably going to be sleeping in a bit.

If and when I actually do work a solid 8-5, M-F schedule one time, my boss would likely send me for help. She literally doesn't care, as long as the work is done. I often goof off during the day because I'm frequently more productive in the evening, so if I have lots of coding to do, I often wait until it's dark.

It's vague, if you have a job without regular work hours does it affect you or not?
Either way, it doesn't seem to stop you working after your regular hours if you want to. Only stops your boss forcing you to work after hours.
Still struggling to understand the objections.

I can't be forced to work more than 48 hrs a week but I worked 70 last week. The other chef here is off work recovering from cancer treatment so I have been pulling double shifts for 2 months now. I could refuse if I wanted to and the law is on my side. I won't because they don't have a lot of choice and because I quite like money. I would hate to have no choice though.
For legal reasons, we are not threatening to destroy U.S. government property with our glorious medieval siege engine. But if we wanted to, we could. But we won’t. But we could.

This may be a shocking revelation for some - but you always have a choice. The choice of “Fuck this job, it’s not worth the money you’re paying me”.

Don’t need a government to do what you can already do for yourself.

My regular work hours are 8-5, an hour for lunch, M-F. I sometimes have to work irregular hours. It's part of the job. If the only requirement to get by the law is that people are sometimes required to work irregular hours, then there is absolutely no point to the law, because most (if not all,) professionals sometimes have to do things off hours.

Yeah I'm salary and I probably average 47 hours a week. I have a base salary that is very near six figures and a annual bonus that puts me way over the $100k mark. No complaints from me. :twisted:
