Of course, a federal statute cannot contravene the Constitution, including the Due Process Clause. That seem to have been the sticking point before the 9th Circuit.
There's where they lose me. The Due Process Clause(s) only apply to US citizens, or, more broadly, people who are at least on US soil (wet foot, dry foot.) Unless, or perhaps
