One of the contradictions of International Law is that the Permanent Five Members of the UNSC can Veto it.

That Veto is invoked on America's behalf at the discretion of the Executive.

So technically, by the letter of the law, the POTUS is above the law, at his discretion.

As are the Chief Executives of Russia, China, Britain and France.

The law was written by the Great Powers, and they wrote it so that they could never be handcuffed by it.
