This isn't a rape trial. Rape shield laws aren't designed for this kind of hearing. Not only is the burden of proof not beyond reasonable doubt, there is NO burden of proof. BK could admit to attempted rape and still get 51 votes for the seat. If rape victims need to prove that there's been a rape, or go to jail if they can't prove it, most of them will remain silent, as it's impossible to prove most of the time.
I don't want people to stop accusing rapists of rape, even in cases where it's impossible to prove. But I also don't want to see innocent people go down with no evidence. A case doesn't need to have a winner or a loser for it to have been handled correctly, because a lot of the time there's simply not enough evidence either way.
It goes both ways... the accuser could admit fraud in making the allegation, and BK could get only 49 votes and not get the job. There's no appeal of that outcome for BK.
Congress could get serious about enforcing its ordinary procedural rules and prosecuting perjury before Congress in a serious manner. Think that's gonna happen anytime soon?

We need only prove they lied. It's the opposite of what they are doing to us.
