If you haven’t realized yet, the courts can’t create laws.

They can push a issue to the legislative branch, but they can’t force a law to be created beyond the means of the legislative branch.

The only people that can do it are the Executive branch such as a decree. But it is not binding like a law is, so the legislative branch still needs to enact a law for the executive branch to sign and the judicial branch to agree upon doesn’t break current laws or constiution rights.

So how many posts until you cite a legally sufficient reason to throw the case out?
Let me bring you back to school.

TC - this is not hard - Courts makes decisions based on precedent (case law) and/or Statutes. In the absence of those, judges can pretty much do what they want as long as they don't run afoul of the constitution. If the people don't like a ruling - they need to get their legislators to over rule it....which means passing a new law and/or altering the corresponding constitution.
Show me the case law they used to force the legislative branch to bypass the normal route of passing a law and forced it to be accepted by 180 days.

Because if that was true, more courts would have abused that power would be all over the net.

The Constitution did not adequately restrain the judiciary. It's not some magic document. It's actually pretty poorly conceived, honestly.

You can prattle on and on about some philosophical nonsense about separation of powers, but the courts DO have these powers and there really is no counterbalance to it.

The judicial has the right to push it back to the legislative and insist the legislative to take action within reason.

The legislative had 180 days to pass the law. Not to initiate working on it...

That is where the judicial does not have the power to do so.

TC, stop the golem act. You have no idea what you are talking about. There exist zero restraints on the judiciary. The judiciary was not conceived as a co-equal to the legislative branch. It wasn't supposed to be the arbiter of the Constitution even at the state level. They just keep claiming power because the Constitution is a fucking joke that was designed to create this leviathan.

Remember when you were a young kid and you'd play war games with your friends? Billy would say something like, oh yeah, my army has advanced laser rifles so you can't win. Then you'd say, well my army has super shields that make your laser rifles useless, so I win. That's what the judiciary is. They just keep claiming special powers and nobody can tell them to shut the fuck up because the Constitution places literally no restraint upon them.

All they have to do, TC, is redefine a fucking word to mean something else. That's what they do all the time. Hello? Earth to TC.
