I think everyone realizes that employers can fire employees for drawing negative attention to the company. Only Monte seems to think this has some connection to “police killing blacks” ... and c’mon - it’s Monte. It’s not like we’re expecting some great proclamation of rational wisdom from that quarter.

It’s interesting that these discussions always come back to the employers right to fire someone, but never whether they should.

I think in an age where everyone with an internet device can draw negative attention to themselves, in so doing they will always risk reflecting poorly on their company. What's proper behavior AT work, that's up to the employer of course. Break the contract, you get fired.
That lady who got fired for making a bad joke on twitter while on holiday, though, or that guy in the "Fiesta" thread who got fired for... well, being a douche tbh, but being a douche in public on his own , personal time? If someone with enough of a grudge at some party you were at, tracked down your personal details, found this forum and found something suitably controversial and sent it to both your boss and tweeted a screenshot and link of your "controversial" opinion... that's where both public and companies should stop and think. Work time is work time, work space is work space, private time is private time and private space is private space. This (OP) case is clearly work time/work space (same as the Google memo guy), but people are increasingly getting fired for shit done or said outside of work, simply because so much of public space these days is caught on camera or hammered into digital stone.

It's not Freedom of Speech. Employers can, and do legally curb employees speech. Insult a customer, get fired.
The Federal Government in fact curbs employees Free Speech with the Hatch Act.
Claiming Constitutional Rights, while not knowing the Constitution doesn't make these fools case better.

ESPN fired Curt Schilling and Mike Ditka for comments about Obama they felt were offensive, they have retained a wide number of empmolyees that have said worse about Trump. There are probably a number of companies already firing people for whatever is found associated with them anywhere on the internet. And, of course, there are already companies whose sole product is finding those items on potential or existing employees.
Does this deserve legal protection, or is it something to be solved by the “free market”?

And why on earth would you assume that it needs to be “detrimental to business”? What’s to stop a staunch liberal/conservative employer from firing people for not being liberal/conservative enough in their posting history?
