Christie v. National Collegiate Athletic Association

New Jersey governor Chris Christie’s efforts to obtain a plum appointment in the Trump administration may have come to naught, but his petition for certiorari was granted by the Supreme Court in Christie v. National Collegiate Athletic Association, potentially the most important federalism case of the term. Under the Professional and Amateur Sports Protection Act (PASPA), states may not “authorize” gambling on amateur or professional sports events. (Four states — Delaware, Montana, Nevada, and Oregon — are exempted under a grandfather clause.) Despite PASPA, New Jersey lawmakers authorized sports betting under state law, prompting the NCAA and other sports associations to sue. There’s no dispute that, under current law, the federal government may prohibit sports betting directly. Current interpretations of the Commerce Clause clearly reach this far. At issue in Christie is something slightly different: Whether federal law can require that states maintain their own pre-existing prohibitions on sports betting, as PAPSA seems to. If the justices agree, this case could have significant implications for other contemporary federalism disputes, including those over marijuana and “sanctuary cities,” where states likewise wish to eliminate state-level prohibitions on activity prohibited under federal law.

That's going to be a very complex question. I haven't had a chance to study the opinion yet to see how broad or narrow the ruling is regarding the federal law that NJ challenged.

This could be pretty limited to NJ, or it could open the flood gates around the country. It is obviously going to increase the overall pie of legit sports book money across the country, and Vegas might be able to have a good part of that capture.

Long story short, its going to be complicated. There's not much, if anything, that is more regulated than legit gaming in the US. Anybody who predicts doom and gloom for Nevada at this stage is a fool. Some competition in a bigger market might just push Vegas to higher levels than ever before.

I ask the question because as gambling has increased in many states people thought the advent of poker and keno machines in other states would hurt vegas.............. it hasn't. Vegas owns the gaming machine industry and since gaming has expanded in other states, Vegas has only gotten bigger and more wealthy.

Vegas will change as it always has. Everyone will decry the loss of old Vegas, maybe rightfully so, but they'll adapt. They have something to offer that online sportsbetting does not. You dont even have to drink or gamble to have fun in Las Vegas anymore.

Should hurt online gambling.
Help government revenue.

Every now and then the government can be convinced to allow for more freedom, provided we put more food into the trough.

The Government needing Revenue badly, is good for Liberty at both the State and Local levels. Government is giving in to traditional 'Sin' Industry to tax it........................ Next Stop, Prostitution.
