If the human driver in the driver seat is just sitting there checking their phone while the self-driving car runs people over, I gotta ask ... what’s the point of having the human in the car?

If somebody is behind the wheel, then by default they are in control and liable.
The only way to get around that is to remove the controls so that everybody is a passenger with only an emergency shutdown switch of some kind.
She should be charged with vehicular manslaughter.
As an aside, this is why I would NEVER work for a company on a project like this. I say that as an AI guy.

Officials said an Arizona woman was killed after being struck by a self-driving Uber vehicle Sunday — an incident believed to be the first of its kind.
The accident in the Phoenix suburb of Tempe caused the company to suspend all testing of self-driving vehicles in cities across the country.
Tempe Police Sgt. Ronald Elcock told Fox News that Elaine Herzberg, 49, was walking outside of a crosswalk when she was struck by the vehicle just before 10 p.m.
What begins? Tens of thousands of people are killed by cars every year.

For the safety of the citizenry, the logic of jaywalking laws will be expanded to the sidewalks of entire streets and possibly neighborhoods, and law abiding citizens will stay off them, just as they don't walk on the freeway.
