But instead of stopping there, Kavanaugh then proceeded to find a different way for the government to win. "Country-of-origin labeling is justified," he asserted, "by the Government's historically rooted interest in supporting American manufacturers, farmers, and ranchers as they compete with foreign manufacturers, farmers, and ranchers." Kavanaugh saw economic protectionism as the way to shield the law from the First Amendment.
For a different perspective on these issues, contrast Kavanaugh's permissive concurrence with the sharp dissent filed by Judge Janice Rogers Brown. "If, as Jeremy Bentham once quipped, a fanciful argument may be dismissed as 'nonsense upon stilts,'" she wrote, "the court's analysis in this case can best be described as delirium on a pogo stick."

Kavanaugh = Roberts.
You have to do the cost benefit analysis here.
He will rule conservatively but never against the state.
Certainly not something I would pick, though call for Lee and Paul.
But not a pill impossible to swallow.
Were I them, I think I would need a compromise else where.

Rosenstein got himself involved in the investigation of Brett Kavanaugh...……………….. hello, Sessions, don't you have anyone else that can do this? You have over 100,000 employees
https://www.nytimes.com/2018/07/11/us/p ... utors.html
od J. Rosenstein, the deputy attorney general, has asked federal prosecutors to help review the government documents of Judge Brett M. Kavanaugh, President Trump’s Supreme Court nominee, according to a letter obtained by The New York Times on Wednesday.
Mr. Rosenstein’s request was an unusual insertion of politics into federal law enforcement. While the Justice Department has helped work on previous Supreme Court nominations, department lawyers in Washington typically carry out that task, not prosecutors who pursue criminal investigations nationwide.
But in an email sent this week to the nation’s 93 United States attorneys, Mr. Rosenstein asked each office to provide up to three federal prosecutors “who can make this important project a priority for the next several weeks.” Names were to be submitted to Mr. Rosenstein’s office by the end of Wednesday.
Mr. Rosenstein’s email, which had the subject line “Personal Message to U.S. Attorneys From the Deputy A.G.,” included the sentence, “We need your help in connection with President Trump’s nomination of Judge Brett Kavanaugh to serve on the Supreme Court.”

Well, the radical left tried to shout down Grassley at the beginning of the Kavanaugh confirmation hearings.
Pretty standard for them anymore. Don't like what the opposition might say, shut them up with force.

I think I see some element of genius here.
The dems are going to blow their wad against this confirmation. It's still not going to stop the confirmation because this guy is just another John Roberts.
Ginsberg is going to die and will be replaced. They might have greater numbers in after the Midterms, but politically they already are burning their brand with these antics. I think there is a good chance we get another Scaliaite next and they won't really be able to stop it without looking like total assholes and losing seats in the House, as well as possibly state offices in swing states.
