And that's what the judge is saying, he's not just responsible for defending himself, he's got everybody in the hotel on his watch there.

If it does turn out to be a mad shooter interrupted in the process of going on a rampage, they can't let that by, they can't let themselves get taken down.
And do we ask the police to take those risks?

Mad shooter scenario:
Call received, no reports of gun fire. Witnesses are credible however and perhaps the shooter is just preparing to begin.

Do we tell them the police they need to be prepared to take a bullet in that situation by assuming a different ROE based on threat assessment?
Well, even if you do, you'll quickly run into a situation where it flips the other way, the cop will wait out, get taken down, then a bunch of innocent people will get lit up by a real deal mad shooter, and then the same people screeching here will be screeching about that.

If you're gonna cave in to the fickle mob of torches and pitchforks, then you're damned if you don't, damned if you do.

What's that expression? Milkshake Duck? Every internet hero, is going to be the Milkshake Duck, when the mob turns on him, inevitably. One day you're the savior, the next day you're the psychopath, the worms turns quick, with the internet mob.

Ya'll troops know how it goes, the US Army is a Milkshake Duck, one minute you were spreading democracy and freedom, the next miniute you were baby killers committing war crimes, but you were the same guys before and after.

You know, Operation Nimrod, the Iranian Embassy Siege at Princess Gate in London, is hailed as one the most brilliantly executed hostage rescues of all time now, but what people don't remember, is that those 22 SAS operators were dragged into court after, to defend themselves from murder charges, because they shot the terrorists before they could reach for a weapon; Milkshake Duck. There's always Monday morning quarterbacks, even for the SAS.

Even Tier One Operators screw the pooch, IIRC, a DEVGRU operator was court martialed, because he threw a hand grenade in a battle, which ended up killing a hostage, shit happens, and then you're the Milkshake Duck, just like that.

It's fucking insane, but it's the natural consequence of the arguments we saw earlier in this thread: "Somebody" called in with a report of a hostage situation. Cops can't take any risks, even when they do not see any evidence of a threat. There might be a terrorist waiting to ambush them around the corner. One in the head and two in the chest. Acquit.
