Warrantless surveillance wasn't in the PATRIOT Act, the Bush Administration was executing warrantless surveillance just under the President's Article II power "Commander of the Army and the Navy" in time of war, it was, ostensibly at least, a war measure under executive authority, not legislative, they didn't even inform Congress that they were doing it.
In the end, the constitution, as written by the Framers, has always included broad executive authority to prosecute wars, and with seperation of powers, you wouldn't be able to elect a Congress which could legislate those away from the Executive, if you invoke the constitution, you have to invoke it all, and that includes the broad executive authority in time of war and/or national emergency, and if the Congress tried to pass a law which removed those authorities, the Executive could simply invoke the constitution to override them.

This was just a one off, Trump fired a few TLAM's in there, deliberately targeting them to hit jack shit, he's not starting a war, it was just a stunt, a few TLAM's popping off is not a war, by American standards, that's peacetime, even if they wanted to, they can't get an actual war going, the Russians are in the way.
