The court of appeal determines the sentence of two months' imprisonment and protection for the Arab who was sentenced in February to rape a 13-year-old girl at a school toilet in Östersund. In addition, he does not have to pay damages of SEK 25,000 to another girl in his 14-year-old whom he was arrested.

Mohammed from Syria was sentenced by the district court to have locked in and raped a 13-year-old girl at a school toilet in Östersund at the end of December last year.
He took the girl into the toilet, locked the door, pushed her up against the wall and held her while raping her. The 13-year-old tried to in vain to make him stop. She was "terrified" because Mohamed was "much older" than her, but tried to hold back the tears during the assault.
Mohammed was charged at the same time for raping another 14-year-old girl in central Östersund earlier in December. In that case, the Arab was sentenced instead of sexual exploitation of children, because the Östersund District Court ruled that the intercourse was "marked by some reciprocity" and the girl did not have long left until her 15th birthday.
The Arab escaped with only two months in prison because he claimed to be born January 1, 1999 and thus 17 years old when the crimes were committed. This bought the right even though the prosecutor pointed out that the Swedish Migration Board had established that the Arab was born in 1998 and thus should be sentenced as an adult.According to the Östersund District Court, the Migration Board's task did not suffice as evidence.
Now the High Court of Lower Norrland determines the District Court's sentence on two months' imprisonment and protection.
According to P4 Jämtland , the court of appeal makes the same assessment as the district court of the debt issue in both cases. But the man does not pay the damages of 25,000 kronor that the district court sentenced to the 14-year-old girl.However, the damages amount to SEK 115,000 to the younger girl.
