So the state's 'parental' rights are now supreme and absolute, above that of the biological parents?

Self-interest often hides behind rationality. Lots of folks make the argument about something else rather than the simple fact they don't want to pay for other people's healthcare.

The childs rights are greater than the parents.Kazmyr wrote:So the state's 'parental' rights are now supreme and absolute, above that of the biological parents?
The battle has been between the childs best interests supported by doctors against the parents only supported by a clinic hoping to get paid to perform a pointless experiment which even they admit will have no curative value.
For legal reasons, we are not threatening to destroy U.S. government property with our glorious medieval siege engine. But if we wanted to, we could. But we won’t. But we could.

This is being talked about far more over there than here. The courts decision is more accepted by the British public when they know the full story.

So when they determine that the child is unable to exercise their rights, the power to exercise them on the child's behalf falls to the state, rather than to the parents? "We understand that this is a gut-wrenching decision for you. Since we believe that you, as the child's biological parents are thus incapable of doing so, we're going to make it for you." I'm sorry, but no parent should have their agency stripped away from them when it comes to this kind of life and death decision for their own child. If they have the means to seek the extra treatment, let them do so. The parents want one chance, that's it. Instead, the hospital runs to the courts because the parents decided to hang everything on an impossible long-shot, and they didn't like that.Montegriffo wrote: The childs rights are greater than the parents.

God forbid, they attempt the treatment and learn something new. Why would we do that when we can run thousands of hours of clinical studies on mice to collect data that a court will likely choose to ignore when a family comes looking for a last-ditch attempt at hope (even if it is futile). Or, who knows, maybe the attempt to treat him could teach something that dramatically improves the life of the next child with this condition. I'm well aware the treatment could, quite likely, result in failure. However, I would do anything for my child. And if she's ever terminally sick or in pain, she's not fucking worrying about dying with fucking dignity. She'd want her mom and her dad. Period. I don't care how learned or rational the judge is, to simply hop in the role of the child and say "Nope, I'd wanna die" is ludicrous.
But at this point, it's the law over there. Nothing can be done about it, now. Two parents are now going to watch their son die, knowing that they couldn't do everything for him, simply because the state knew better.

The child is already dead. Brain death, deafness, blindness, and comatose. That is a vegetable, not a child. It's tragic, but there was never a "life" option on the table.
