Smits is right on, as far as tactics go.
He's just trolling a little bit.
Obviously, if you are a gibs employee and find yourself in any kind of trouble, of any sort, say gibs me muh lawyer and STFU.
Not fucking rocket science, troops.
As long as you allow the state to gibs jobs, don't act all surprised when an employee of the state gets all IT'S LEGALLLLL! on your country ass.

My favorite part is when he’s all...
The guy who sent a US state into a panic because his ass can’t figure out how buttons work in 2018? That the non-rube you’re not decrying?
Excellent selection of hills upon which to die.
Right-o!

Neither is that federal worker in hawaii, apparently.Smitty-48 wrote:Fallacy, the case in question is a formal investigation, upon any formal investigation, you are entitled to legal counsel, or at least we are, maybe it doesn't work that way in America, but that's how it works under the rule of law.Okeefenokee wrote:Hey private, you were supposed to fuel the generator. It ran out last night, and the TOC lost power. What happened?Smitty-48 wrote:
I've never had a union job, but even in the army, I was never forced to speak while under investigation without legal counsel, which in the army is an assisting officer, and in every case the assisting officer advised me to say nothing and to allow him to speak on my behalf, and for any soldier that I placed under investigation, I advised them to consult with their assisting officer before they said anything, and that was all entirely consistent with the Queen's Regulations and Orders, not a perk at all, merely due process of the law.
I want my lawyer
Moreover, said Private Soldier exampled would not be subject to termination of contract for such a mistake, wouldn't even be subject to formal investigation in fact.

Re: Hawaii Missile Threat: False Alarm
You can't be physically forced to divulge facts to command that would otherwise incriminate you, but if those facts are in any way relevant to the mission, once the chain of command becomes aware of them, you are facing additional charges, I am sure.
If we are talking about something like, "who took a shit out the second floor window of the barracks onto the bike rack", and you don't fess up, then I doubt it really matters that you failed to confess. You are still getting some horrible punishment for that.
But if we are talking about, "why is there threatcon delta alert in place", and you don't immediately admit you pushed the wrong button, then yeah, you are getting additional troubles when they find out you pushed that fucking button. That's not years of shit details. That's prison.

There is no middle ground, either an investigation has the force of law or it doesn't, if it does, lawyer up, if it doesn't, ignore it.Okeefenokee wrote:

I mean, duh.
Basically this guy is just calling their bluff, if they want to charge him with something, so be it, if not, take a lap, FCC.
That's how I roll too, if the CRTC here wanted me to answer questions, I'd just ignore them.
If they want to send the RCMP instead, talk to my lawyer.
What's the charge, officer? Pushing the wrong button? Yeah, OK, good luck with that, see in you court.

Turns out that the person pulling the trigger didn't think it was a false alarm...

The FCC has published the preliminary findings of its investigation into Hawaii's false missile alert, and it suggests that the story didn't play out as you might have heard. Where initial reports claimed the Hawaii Emergency Management Agency officer who triggered the mass panic clicked on the real alert by mistake, the FCC said the officer fully intended to click it -- because they'd misinterpeted a mangled message. Reportedly, the midnight shift supervisor had played a standard recording that included both the usual "exercise, exercise, exercise" language and the text from a real Emergency Alert System message, which includes "this is not a drill." Although other officers saw this was a drill, the one who clicked the alert was convinced it was real.

He did get fired though, along with the supervisor. Which kinda makes most of this thread look silly.
