Congress has its sticky lil' fingers in regulating commerce either way... sort of their job. They aren't 'forcing' the issuer into extending credit anymore than they are forcing the holder to accept it by addressing the legality of particular terms of agreement.

Item 2 is already illegal. They can change terms going forward but not retroactively AFAIK.
