Does dishonorable discharge really preempt your ability to purchase a gun? I can see a CCW permit being affected, but not your ability to purchase a gun. People get dishonorable discharges for stupid shit all the time. For example, cheat on a test and you are gone.

Kelley was NOT dishonorably discharged; he was bad-conduct discharged, which doesn't prohibit firearm possession

The Domestic Violence Offender Gun Ban, often called "the Lautenberg Amendment" ("Gun Ban for Individuals Convicted of a Misdemeanor Crime of Domestic Violence", Pub.L. 104–208,[1] 18 U.S.C. § 922(g)(9)[2]), is an amendment to the Omnibus Consolidated Appropriations Act of 1997, enacted by the 104th United States Congress in 1996, which bans access to firearms by people convicted of crimes of domestic violence. The act is often referred to as "the Lautenberg Amendment" after its sponsor, Senator Frank Lautenberg (D - NJ).
Domestic abuse in the military is automatic discharge because you aren't allowed to use a firearm.

Yeah. I don't know what to make of it. I know for a fact DD preempts one from purchasing firearms though.

Every soldier knows about the Lautenberg amendment.Nukedog wrote:Yeah. I don't know what to make of it. I know for a fact DD preempts one from purchasing firearms though.
Every soldier gets briefed every week before the weekend on what not to do. Domestic abuse triggers the Lautenberg amendment. Can't have a gun, can't be in the Army.
This guy was discharged for domestic abuse. It was already against the law for him to have a gun. His facebook post from last week could have been enough to prevent this.
Someone bought him that gun.

Doesn't really matter to my mind. Criminals don't care about laws.

Right. I'm agreeing with you. Just clearing up the uncertainty on the DD vs BCD in regards to which lets you have a gun. You could be honorably discharged with a medal of honor, if you get a domestic violence conviction, no more gun.Nukedog wrote:Doesn't really matter to my mind. Criminals don't care about laws.
Kelley was discharged from the Air Force in 2014, according to Defense Department records. Kelley was court-martialed in November 2012 for assaulting his wife and their child. A judge sentenced him with a bad-conduct discharge, 12 months confinement, and two reductions in rank to basic airman, according to an appeals court decision in 2013 that affirmed the decision against Kelley.
