A couple of minor (?) other points that may be worth consideration, 1. Airline travel, which was being impacted by the shutdown, will be back to normal during Pro Bowl and Superbowl weekends. 2. Presumably, Trump will now get to deliver his State of the Union address in the House on the 29th or have the opportunity to make Pelosi look even more petty by denying his invitation to do so per her letter.

Thoughts? I am not looking to make excuses but just wondering about the potential upsides for this move by Trump.

About the only upside for Trump personally I see is that Jared and Ivanka are satisfied.

For the rest of us? Are we supposed to think that a (still fanciful) outcome where Trump blows up executive overreach is good for us somehow?

If he lays so much as a single brick in 3 weeks, I’ll publicly declare my inadequacy

It’s possible that he does the “national emergency” thing, but not likely. Seems like a dangerous precedent, similar to the PATRIOT act, but at this point... fuck it. We already burned the Holy Rag of 1778.

The dangerous precedent was giving Congress the ability to do the Executive's job by itemizing the budget down to the last detail with instructions.

Securing the border is the President's constitutional role and authority. The only thing Congress needs to do is collect taxes and give funds to the President. It is NOT their job to determine how to secure the border, who gets to walk in without permission, etc.

Everybody talks about how Congress gave up things like war powers to the Executive branch, but it's also true that the Executive branch gave up powers to Congress. It's a huge mess.

“Enumerated powers” were always going to be increased by the group empowered to create them. This is part of the design.

The President does not have to ask the Congress for permission to secure the national borders from invasion.
