We know this because the Obama ordered the intelligence community to spy on them.There exists a recording of the conversation. The former acting Attorney General, besides refusing to do her job, used that information (which was provided to her by somebody within the intelligence community) to try to destroy Flynn. If Flynn actually did something illegal, you better believe we'd know it. Instead all they could get on him was that he misrepresented the content of the discussion to Pence.

Trump will be better off if he just does what Pence, Mattis and Kelly tell him to do.
