If I sit down in a restaurant and order a meal, I'm agreeing by custom and implication that I'll pay the tab when the meal is done.

If I go to an all you can eat buffet, I'm agreeing by custom and implication that I won't stuff extra food in my backpack to take home, and that I won't commit waste by taking food to my table that I don't intend to actually eat.

The difference in these types of contracts and the general "social contract" is that I voluntarily chose to enter into some sort of contract with the restaurant.

I never signed shit as a "social contract," and 90+% of what someone else might say amounts to an "implied" social contract is actually strong-arm theft.

TL;DR -- Legal and moral contracts require the voluntary assumption of some duty to act in consideration of another party's assumption of some duty to act. VOLUNTARY assumption of duty makes a contract.
